ORC Training has developed courses in all aspects of the right-of-way acquisition process – appraisal, negotiation, relocation assistance, highway plan reading and project management. Most of these courses can be presented in a web-based format or delivered in half-day, one-day or two-day sessions.

Many of the topics are developed in a modular design and can be customized for individual needs.

In recognition of the firm's comprehensive experience and expertise, the Federal Highway Administration (FHWA), the National Highway Institute (NHI) and the Federal Aviation Administration (FAA) have selected ORC to develop courses on appraisal procedures, appraisal reviews, title requirements, and residential and business relocations. In addition, the FHWA has contracted with ORC for research studies on right-of-way acquisition and relocation assistance issues and land use management issues.

Acquisition Requirements Under the Uniform Act

Description:

This course is designed to provide transportation professionals with specific information about the basic acquisition policies listed in §24.102, such as providing notice to owner, establishing the amount of just compensation, making a written offer to purchase, providing a summary statement of the amount offered as just compensation, following basic negotiation procedures identified in the regulations, not taking coercive action against the owner, and the authority of the Agency to negotiate an administrative settlement with the owner.

Appraisal Concepts for the Negotiator

Appraisal Concepts for the Negotiator

Description:

The course is designed to assist experienced negotiators in focusing on appraisal issues that are important during the negotiation process. In addition, the course addresses the negotiator's role in the overall project and how a negotiator's expertise can assist in completing a transportation project effectively and efficiently. Participants will apply these concepts in case study scenarios.

Description:

The Uniform Relocation Assistance and Real Property Acquisition Policies Act as amended (Uniform Act) and its implementing regulations require the uniform and equitable treatment of persons displaced from their homes, businesses, or farms and establish uniform and equitable land acquisition policies for public programs using Federal funds. This course goes beyond the basic functional areas of relocation assistance and concentrates on areas of specific concern, such as the 30% rule, carve-out of major exterior attribute, buildable lot rule, mixed use properties and alternate highest and best use other than residential.

  • Explain when the “30% Rule” is used in the rental assistance calculation

Description:

This course is designed to help provide information about two types of highway plans; construction and right of way. The construction portion of the plans is used to provide information about the design of the roadway, the type and quantities of construction materials and the various types of methods used to complete the work. The right of way portion of the plans provides the agent with detailed information associated with the acquisition of the right of way for a highway project. The right of way plans show the names of the property owners from whom the right of way must be acquired, the required area of take, property lines, improvements and existing and proposed rights of way.

Outcomes:

Upon completion of the course, participants will be able to:

  • Read, interpret and relate to a set of right of way and construction plans
  • Identify and interpret symbols used in these plans
  • Develop the necessary skills to interpret a set of plans in non-technical terms to property owners and others

Introduction to Real Estate for Public Agencies

Description:

The Uniform Relocation Assistance and Real Property Acquisition Policies Act as amended (Uniform Act) and its implementing regulations require the uniform and equitable treatment of persons displaced from their homes, businesses, or farms and establish uniform and equitable land acquisition policies for public programs using Federal funds. Title III of the Uniform Act addresses real property acquisition policies, including appraisal requirements.

The course is designed to introduce transportation professionals to the basic concepts and requirements of the Uniform Act and 49 CFR Part 24. It provides information about the history of right-of-way, title and deeds, appraisal and appraisal review, acquisition/negotiations, relocation assistance, property management, environmental concerns, and grants and federal-aid participation.

Land Acquisition for Airports – The Basics

Description:

The Uniform Relocation Assistance and Real Property Acquisition Policies Act as amended (Uniform Act) and its implementing regulations require the uniform and equitable treatment of persons displaced from their homes, businesses, or farms and establish uniform and equitable land acquisition policies for public programs using Federal funds. Title II of the Uniform Act addresses relocation assistance policies.

This course is targeted at airport employees responsible for land acquisition under the Uniform Act and FAA regulations, as well as those persons responsible for oversight of those activities. It provides an overview of federal-aid requirements, and addresses appraisal, acquisition/negotiation and relocation.  This training also addresses disposal requirements for airports, working with consultants and managing the project schedule.

Description:

The Uniform Relocation Assistance and Real Property Acquisition Policies Act as amended (Uniform Act) and its implementing regulations require the uniform and equitable treatment of persons displaced from their homes, businesses, or farms and establish uniform and equitable land acquisition policies for public programs using Federal funds. Title II of the Uniform Act addresses relocation assistance policies.

This course describes the requirements governing the provision of relocation payments to a person displaced from a mobile home and/or mobile home site who meets the basic eligibility requirements. This course goes beyond the basic functional areas of relocation assistance and concentrates on areas of specific concern such as realty vs. personalty, describing moving and related expenses, identifying ownership scenarios, and calculating owner vs. tenant-maximum replacement housing payments.

Description:

Title II of the Uniform Act addresses relocation assistance policies.

This course is a comprehensive overview that develops a practical knowledge of the process and procedures involved in providing relocation assistance to business occupants. Material presented is based on the regulations promulgated by the lead agency (Federal Highway Administration) in implementing the Uniform Relocation Assistance and Real Property Acquisition Policies Act and all subsequent statutory and regulatory amendments. Topics include expenses in §24.301(g) with the exception of calculating actual direct loss and substitute personal property and high bulk/low value.

The Uniform Relocation Assistance and Real Property Acquisition Policies Act as amended (Uniform Act) and its implementing regulations require the uniform and equitable treatment of persons displaced from their homes, businesses, or farms and establish uniform and equitable land acquisition policies for public programs using Federal funds. The course is designed to help agents to answer questions, meet technical needs, and broaden the knowledge of those engaged in the relocation of persons as a result of the acquisition of real property required for a Federal or Federally funded project. The course topics include determining the status of multiple occupants, identifying and addressing illegal aliens and assessing and calculating incidental expenses. This will give the agent the expertise to assist in completing a transportation project effectively and efficiently.

Description:

The Uniform Relocation Assistance and Real Property Acquisition Policies Act as amended (Uniform Act) and its implementing regulations require the uniform and equitable treatment of persons displaced from their homes, businesses, or farms and establish uniform and equitable land acquisition policies for public programs using Federal funds. Title II of the Uniform Act addresses relocation assistance policies.

This course provides specific information on the various aspects of business relocation and is designed to address the process involved in moving a business. The course will explain the necessary steps to take in order to relocate a business, beginning with the options available for reimbursement of move costs to the monitoring of the move to the replacement site. It stresses how to avoid costly problems. The main topics include nonresidential move options, performing an inventory for a nonresidential move, bids and estimates, bid adjustments, move specifications and monitoring nonresidential moves.

EPA Permanent Relocation Procedures for Superfund Sites

Description:

This is a two and one-half day training course on permanent relocation procedures and processes at EPA Superfund sites. This course is directed to a target audience of Superfund Remedial Project Managers, Community Involvement Coordinators, and representatives from the Office of Regional Counsel, and real estate experts with the United States Army, Corps of Engineers (USACE) who are currently or reasonably anticipate providing relocation support to the EPA. It provides a comprehensive overview of fundamental relocation procedures under the Uniform Act and 49 CFR Part 24.

ORC Training - Course and Payment Policies

Examination
Many ORC Training courses include a written final exam. Students must achieve a passing score of at
least 70 percent to receive course credit.

Course Completion/Attendance
In order to complete an online course, a student must review all of the information for that course and
complete all examinations and exercises. For instructor-led courses, the student must physically
attend the full course, including examinations. Any participant that fails to attend the scheduled class
hours may, at the discretion of the instructor, make up the missed subject matter.

Cancellation Policy
All classes scheduled by ORC Training are subject to cancellation. All class registrants are
encouraged to contact ORC Training prior to making travel arrangements, keeping in mind that the
class may be canceled at any time at ORC Training’s discretion. Fully liquidated damages for any
losses incurred by a class registrant are limited solely to a refund of the registrant’s prepaid course
registration, if any, and ORC Training assumes no other registrant liability resulting from class
cancellation. ORC Training will attempt to notify all registered students approximately 30 days in
advance of the course’s status, but it is the responsibility of the student to contact ORC Training to
verify course status prior to making travel arrangements.

Tuition Refund Policy
Written notification must be received by ORC Training prior to the class start date to be eligible for a
tuition refund. A 100% tuition refund or credit will be issued if notice is received by ORC Training
30 days or more prior to the class start date. A 75% tuition refund or credit will be issued if notice
is received by ORC Training with less than 30 days prior to the class start date. No refund will be
issued for notice received on or after the class start date. A 100% tuition refund or credit will be
issued in the event that ORC Training cancels a class.

Course Pricing
Courses are priced individually, commensurate with the cost of offering each course and the materials
required. Group discounts may be negotiated, and discounts for bundled courses may be offered at
the discretion of ORC Training. Bundled courses must be purchased as advertised to qualify for bundle
pricing.

Our Instructors

ORC Training’s instructors are subject matter experts in appraisal, acquisition and relocation assistance. They have a broad range of experience working with and for federal agencies, state transportation departments, aviation authorities, transit agencies, and local public agencies.

These instructors combine their expertise and experience into a challenging, interactive learning environment for participants.


Lisa Barnes

Lisa Barnes, SR/WA, R/W-RAC is the Vice-President of ORC Training, LLC, an affiliate of O. R. Colan Associates (ORC), where she develops internal and external training for the company. Ms. Barnes was recognized as an Instructor of Excellence by the National Highway Institute in 2009, 2010, and 2011. She has over 20 years experience in work under the Uniform Act, and began her career with the Florida Department of Transportation in the areas of land acquisition, relocation assistance, eminent domain and property management.

Ms. Barnes is a co-developer of the new NHI right of way course for Local Public Agencies as well as NHI’s three relocation courses. Lisa’s style of training emphasizes the practical application of Federal, State and local rules and procedures that are used throughout the nation.


Bob Merryman

Bob Merryman began his right of way career with Missouri Highways and in 1978 joined O.R. Colan Associates. He was named an Instructor of Excellence by the National Highway Institute in 2007, 2009, 2010 and 2011. Mr. Merryman is a Certified Appraiser in the State of Missouri and has more than 30 years of experience in acquisition and relocation work under the Uniform Act.

Mr. Merryman is the co-developer of the new National Highway Institute right of way course for Local Public Agencies. He has also developed and instructed courses for the Environmental Protection Agency, National Park Service, Federal Aviation Administration, National Transit Institute and the National Highway Institute. His training style emphasizes engagement of the participants to maximize the learning process.


Ted Pluta

Ted Pluta has been recognized as an Instructor of Excellence by the National Highway Institute in 2007, 2008, 2009, 2010 and 2011. Mr. Pluta began his right of way career with the Florida Department of Transportation and just celebrated his 25th anniversary with ORC.

Mr. Pluta has managed projects with FHWA funding, FAA funding and a variety of state programs and Local Public Agency programs including highway expansions and water management programs. Ted’s style of training engages the practical application of Federal, State and LPA rules and procedures that are actively used on assorted programs throughout the nation.


Richard Moeller

Richard Moeller has over 40 years’ experience in real estate appraisal, appraisal review of all types of property for right of way acquisition for federally assisted highway, transit, and environmental programs.

Prior to retirement from FHWA, Richard served as the Real Estate Program Manager for the Federal Highway Administration (FHWA) for 30+, with approximately 10 years of that service as the agency’s Chief Appraiser.


Robert Kleinburd Robert Kleinburd was employed by the Federal Highway Administration (FHWA) for over thirty-eight years, primarily in the areas of Right of Way and Environment. He had permanent assignments in four FHWA Division Offices, as well as the Headquarters Office. As a Division Right of Way Officer, Robert participated in all phases of Right of Way activity. Robert has been recognized as an Instructor of Excellence by the National Highway Institute in 2011.
